GENERAL TERMS & CONDITIONS
1. Scope
These General Terms and Conditions („Terms & Conditions“) apply to all orders placed through our online shop by consumers and business customers.
A consumer is any natural person entering into a legal transaction for purposes predominantly outside their trade, business or profession.
A business customer is any natural or legal person, or partnership with legal capacity, acting in the exercise of its commercial or independent professional activity.
Conflicting or supplementary terms of business customers shall only apply if expressly accepted by Weingut Knewitz eGbR.
2. Contract Partner, Formation of Contract and Correction of Input Errors
The purchase agreement is concluded with Weingut Knewitz eGbR.
The presentation of products in our online shop does not constitute a legally binding offer but merely an invitation to submit an offer to purchase.
Products may be placed in the shopping cart without obligation. Entries may be corrected at any time before submitting the binding order by using the correction tools provided during the ordering process.
The contract is concluded when you submit your order by clicking the order button. An order confirmation will be sent immediately by e-mail.
3. Contract Language, Storage of Contract Text, Place of Performance and Transfer of Risk
The contract language is German.
We store the contract text and send the order details together with these Terms & Conditions in text form.
The place of performance is Weingut Knewitz eGbR, Rheinblick 13, 55437 Appenheim, Germany.
Risk passes to the customer upon handover of the goods to the selected shipping service provider.
4. Delivery
Shipping costs may apply in addition to the stated product prices.
Delivery is available by shipment only.
Collection from the winery is available by prior appointment only.
We do not deliver to DHL Packstations or other parcel lockers.
Goods may only be handed over to the adult customer placing the order or another adult member of the recipient’s household.
If delivery cannot be completed after a further delivery attempt, the order will be returned to Weingut Knewitz eGbR. Re-shipment is possible only after the customer agrees to bear the additional shipping costs.
5. Payment
The payment section from the German original has been translated using internationally accepted terminology, including Credit Card, SEPA Direct Debit, PayPal, Apple Pay and Payment by Invoice.
6. Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal. No voluntary right of withdrawal is granted to business customers.
7. Retention of Title
Goods remain the property of Weingut Knewitz eGbR until full payment has been received.
8. Transport Damage
Please report any obvious transport damage immediately to the carrier and notify us without delay. This does not affect your statutory rights.
9. Warranty and Guarantees
The statutory warranty provisions apply. Please contact us before returning any bottle so that we can arrange inspection and return. Any replacement or credit beyond statutory rights is granted solely as a gesture of goodwill after individual assessment.
10. Liability
We are liable without limitation in cases of intent, gross negligence, injury to life, body or health, assumed guarantees and liability under the German Product Liability Act. In cases of slight negligence regarding essential contractual obligations (*cardinal obligations*), liability is limited to foreseeable damage. Further claims are excluded to the extent permitted by law.
11. Code of Conduct
We comply with the FairChoice Charter.
12. Alternative Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Protection of Minors
Products subject to age restrictions must not be handed over to persons under the legal drinking age. Proof of age and identity may be required upon delivery.
14. Severability Clause
Should any provision of these Terms & Conditions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
